These General Terms and Conditions ("hob-hob GTC"), together with the Privacy Policy, govern the use of the hob-hob online platform (“hob-hob Platform”), which can be accessed through www.hob-hob.com and certain mobile apps published by hob-hob ("hob-hob Apps").
The hob-hob Platform is available to users worldwide, connecting explorers (users booking experiences) with creators (user offering experiences) for photography experiences. By using our platform, you agree to comply with these GTC.
1. About Us
1.1 Hob-hob operates an online platform to connect explorers with independent creators offering photography experiences ("experiences"). Hob-hob serves solely as a marketplace, facilitating the discovery, booking, and payment for experiences. Hob-hob does not provide or organize the experiences listed on the platform, nor does it assume liability for the quality or execution of these services.
1.2 Hob-hob does not participate in the agreements between explorers and creators. Hob-hob is not responsible for the fulfillment of any contractual obligations between these parties.
1.3 Payments for experiences are processed through hob-hob’s platform. Hob-hob collects a service fee from each transaction for providing platform services, including secure payment processing.
2. Scope
2.1 These hob-hob GTC apply to all visitors and users of the hob-hob Platform, including explorers and creators.
2.2 These GTC apply to all services provided by hob-hob unless more specific terms and conditions prevail for a particular service.
2.3 The use of the hob-hob Platform is for personal purposes only. Commercial activities, such as the resale of experience slots, are strictly prohibited without prior written consent from hob-hob.
3. Role of hob-hob
3.1 Hob-hob is a neutral intermediary that facilitates connections between explorers and creators. Hob-hob does not provide, manage, or control the experiences listed on the platform.
3.2 Hob-hob does not guarantee the quality, safety, legality, or accuracy of the content provided by creators, nor does it verify the qualifications or capabilities of the creators.
3.3 Any disputes, claims, or concerns regarding an experience must be resolved directly between the explorer and the creator. Hob-hob does not mediate or arbitrate disputes between users.
3.4 Hob-hob is not liable for any damages, losses, or injuries resulting from participation in experiences or interactions between explorers and creators.
3.5 Hob-hob reserves the right to restrict, limit, or deny the use of the hob-hob Platform in case of suspected fraud, violation of these GTC, or other misuse of the platform.
4. Registration and hob-hob Account
4.1 Although registration is not required to browse the hob-hob Platform, you must register to book an experience or list your services as a creator.
4.2 Users are responsible for keeping their account information secure and ensuring no unauthorized access to their accounts. Hob-hob is not liable for any misuse of accounts.
4.3 Hob-hob reserves the right to suspend or terminate accounts in cases of suspected fraud, misuse, or violation of these GTC.
5. Payment and Fees
5.1 Payment Processing: Payments for experiences are facilitated through hob-hob’s platform using a secure escrow system. Hob-hob collects payments from explorers, holds the funds securely, and releases them to creators after the successful completion of the experience.
5.2 Service Fee: Hob-hob charges a service fee, deducted from the payment before transferring funds to the creator. This fee covers platform services, including secure payment processing.
5.3 Refunds are processed as follows:
• Explorer Cancellations (More than 24 Hours): Explorers who cancel more than 24 hours before the scheduled experience will receive a full refund, including the service fee.
• Explorer Cancellations (Less than 24 Hours): Cancellations made less than 24 hours before the scheduled experience are non-refundable.
• Creator Cancellations: If a creator cancels the experience, the explorer will receive a full refund, including the service fee.
5.4 Non-Refundable Fees: Hob-hob’s service fee is non-refundable except in the following cases:
• When the explorer cancels the experience more than 24 hours before the scheduled time.
• When the creator cancels the experience.
5.5 Liability for Payments. Hob-hob disclaims liability for:
• Payment disputes between explorers and creators, which must be resolved directly.
• Delays or errors in payment processing caused by third-party payment providers.
5.6 Refund Process for Creator No-Show: If a creator fails to attend or conduct the scheduled experience:
• The explorer must notify hob-hob within 48 hours via hello@hob-hob.com or the platform’s support system.
• Upon verification of the no-show, hob-hob will refund the explorer in full, including the service fee.
• Hob-hob reserves the right to request evidence (e.g., screenshots or communication logs) from both parties to verify the claim of a creator no-show.
• Repeated no-shows by a creator may result in account suspension or termination.
6. Liability
6.1 Hob-hob excludes liability for:
• Cancellations or No-shows: Hob-hob is not responsible for cancellations or no-shows by either creators or explorers.
• Platform Crashes: Hob-hob is not liable for technical issues, interruptions, or outages that affect the use of the platform.
• Accidents or Injuries: Hob-hob is not responsible for any damages, injuries, or losses arising from participation in an experience.
6.2 Hob-hob’s liability is limited solely to the operation of the platform and secure payment processing.
6.3 Hob-hob is not liable for loss or damage arising from force majeure events, including natural disasters, cyberattacks, or government restrictions.
7. Cancellations and Rescheduling
7.1 Cancellations by Explorers
• More than 24 Hours: Explorers may cancel an experience more than 24 hours before the scheduled time and receive a full refund, including the service fee.
• Less than 24 Hours: Cancellations made less than 24 hours before the scheduled experience will be fully charged, and no refund will be provided.
7.2 Cancellations by Creators
• Creators must notify explorers immediately if they cancel an experience. In such cases, the explorer will receive a full refund, including the service fee.
• Repeated cancellations by a creator may result in suspension or termination of their account to maintain trust and platform reliability.
7.3 Rescheduling Requests
• Rescheduling is permitted if both the explorer and creator mutually agree. All communication and arrangements for rescheduling must be handled - directly through the hob-hob platform’s messaging feature or other preferred communication methods.
• Hob-hob does not manage or guarantee rescheduling but provides tools to facilitate communication between users.
8. Reviews and User Content
8.1 Users may post reviews of experiences they have attended. Reviews reflect personal opinions and do not represent hob-hob’s views.
8.2 Users are fully responsible for the content they post on the hob-hob Platform. Content must not be misleading, offensive, or violate the rights of third parties.
8.3 Hob-hob reserves the right to remove user content that violates these terms.
9. Indemnification
9.1 Users agree to indemnify and hold harmless hob-hob, its affiliates, and employees from any claims, losses, damages, or expenses arising from:
• Misuse of the hob-hob Platform.
• Non-compliance with these GTC.
• Disputes between explorers and creators.
10. Community Guidelines
Hob-hob is committed to creating a positive, safe, and respectful community for all users. By using the hob-hob Platform, you agree to abide by the following Community Guidelines. These guidelines are an integral part of these Terms and Conditions, and failure to adhere to them may result in removal of content, suspension, or termination of your hob-hob Account.
10.1 Respectful Conduct:
All users are expected to treat each other with respect. Discriminatory behavior, harassment, or any form of verbal abuse, including racism, sexism, or hate speech, is strictly prohibited.
Respectful communication is expected in all forms of interaction, whether on the platform or in person during experiences.
10.2 Prohibited Content and Activities:- No Violent, Sexual, or Otherwise Inappropriate Content: All content shared on the hob-hob Platform, including experience descriptions, messages, or any other form of communication, must be appropriate for a public community setting.
• Illegal Activities: Experiences or interactions that encourage illegal activities are strictly forbidden.
10.3 Authenticity and Honesty:
Users must provide accurate information, both when registering on the hob-hob Platform and in experience listings. Misleading claims or fraudulent activity will result in suspension or account termination.
10.4 Respect for Privacy:
Personal data and contact details of others should not be shared without their explicit consent.
10.5 Compliance with Local Laws:
All activities facilitated through the hob-hob Platform must comply with applicable local, national, and international laws.
11. Governing Law
11.1 These hob-hob GTC are governed by the laws of Switzerland. Any disputes will be resolved under the jurisdiction of the courts in Zurich, Switzerland.
12. Final Provisions
12.1 hob-hob may modify these GTC at any time. Users will be informed of changes in advance.
12.2 If any provision of these GTC is or becomes void or ineffective, this shall not affect the validity of the remaining provisions.
